<span style="color: red; font-size: large;"><br />Oui, à compter du 14 mai 2013, une copropriété
peut souscrire un emprunt collectif. Les modalités viennent d’être précisées par
un décret publié au Journal officiel du mercredi 13 mars 2013. Ce décret
concerne les emprunts souscrits par les syndicats de copropriétaires pour
financer notamment des travaux sur les parties communes ou encore, par exemple,
des travaux d’intérêts collectifs sur les parties privatives.</span></div>

<span style="font-size: large;"><span style="color: blue;"><br />Les conditions générales et particulières du
projet de contrat de prêt collectif ainsi que la proposition d’engagement de
caution s’ajoutent ainsi à la liste des informations notifiées par le syndic aux
copropriétaires en vue de la tenue de leur assemblée générale.</span> <br /><br />Le décret
définit la notion de défaillance du copropriétaire établie à l’expiration d’un
délai de 30 jours. En cas de transfert de la propriété d’un lot, le document
transmis au notaire par le syndic doit comporter le montant de l’emprunt en
question. Dans le cas également d’un transfert de propriété, le décret impose la
notification au syndic de l’accord du prêteur, de la caution et du nouveau
propriétaire sur les sommes restant à rembourser par l’ancien propriétaire du
lot qui passent à la charge de l’acquéreur du lot.</span></div>

<span style="color: blueviolet; font-size: large;"><br />Ce décret fait suite à l’article 103 de
la loi du 22 mars 2012 qui porte sur la sécurisation des emprunts contractés par
les syndicats de copropriétaires (majorité requise pour la souscription d’un
emprunt par le syndicat, participation optionnelle des copropriétaires à
l’emprunt, cautionnement de l’emprunt...). Selon l’article 103 de cette loi, ces
dispositions entrent en vigueur à l’expiration d’un délai de 2 mois après la
publication du décret d’application.</span></div>
